The Probate Judge is an elected official who oversees a wide range of legal and administrative services that affect the everyday lives of our residents.
These include:

Probating wills

Administering estates
-
Appointing guardians and conservators

Involuntary mental health commitments
-
Adoptions, legitimations, name changes, etc.

Presiding over condemnation proceedings
The Probate Court is committed to serving all residents equally — regardless of age, race, gender, or economic status.
The Henry County Probate Judge is elected to a six-year term by voters across the entire county.
Uniquely, in Henry County, the Probate Judge also serves as the Chairman of the Henry County Commission, one of sixteen counties in Alabama with this structure.

In addition to leading the Commission, the Probate Judge:

Serves as the chief election official for the county

Is a member of the three-person election oversight team with the Circuit Clerk and Sheriff

Certifies candidates, prepares ballots, programs voting machines, and certifies election results

The Judge also serves as custodian of county funds, buildings, and inventories, and sits on multiple local and regional boards.

In 2022, the Herndon Building at 102 North Court Square became the new home of the Probate and County Commission offices thanks to a generous gift from David and Maribeth Herndon. (Document recording remains in the original Probate Office at 101 Court Square, Abbeville, on the ground floor of the courthouse.)
